Terms of Service

These terms govern your use of ActivateClaw as a deployment tool for OpenClaw.

1. Service Scope and Ownership Boundaries

ActivateClaw deploys OpenClaw to dedicated VPS infrastructure. We do not own OpenClaw, and OpenClaw remains third-party software under its own license and terms. ActivateClaw is provided on an "As-Is" and "As Available" basis.

2. Eligibility

You must be at least 18 years old to use ActivateClaw. By creating an account, you confirm that you meet this requirement.

3. Your Server, Your Responsibility

After provisioning, your server and workload are yours to control. You are solely responsible for maintenance, updates, backups, hardening, and legal compliance of what runs on that server. We do not provide full managed DevOps for your OpenClaw application.

4. Your Data and Content

You retain all ownership of your data, conversations, and content stored on your VPS. We do not claim any intellectual property rights over your content. We only access your server programmatically during provisioning and configuration — we do not monitor or read your conversations.

5. Hetzner Acceptable Use (Strict and Enforced)

You must comply with Hetzner's Acceptable Use Policy and applicable laws. Crypto mining, DDoS activity, spam, malware distribution, credential attacks, network scanning, and related abuse are strictly prohibited.

Zero tolerance for crypto mining or network abuse. Violations result in immediate ban, suspension, or termination without notice.

6. Best-Effort Commitments and Failure Cases

We do our best to keep the promises reflected on the landing page (fast provisioning, secure defaults, dedicated infrastructure, and setup convenience), but these are best-effort commitments and not absolute guarantees.

Security incidents, upstream outages, dependency vulnerabilities, cloud/network failures, and unexpected software behavior can still happen.

AI auto-configuration from dashboard is also best-effort. We attempt to validate and apply settings, but this can fail due to provider changes, API errors, networking issues, instance readiness timing, or invalid credentials. Manual setup in OpenClaw may still be required.

7. Billing and Refunds

Billing is subscription-based and handled by Polar.sh as Merchant of Record. Because infrastructure spend is committed immediately to Hetzner and payment processing is committed through Polar, there are no refunds for active servers.

Refunds are available only for verified deployment failures where your instance was not successfully delivered or activated.

8. Price Changes

We reserve the right to change subscription pricing. If prices increase, existing subscribers will be notified via email at least 30 days before the change takes effect. You may cancel before the new price applies. Price decreases take effect immediately for all subscribers.

9. Account Cancellation

You can cancel your subscription at any time from your dashboard. After cancellation, your instance remains active until the end of your current billing period. After that, the standard retention policy applies: 7-day grace period, then 14-day suspension, then permanent deletion (21 days total).

10. Lifecycle, Suspension, and Deletion

We may suspend or terminate access for non-payment, policy violations, or abuse. Subscription and lifecycle automation may trigger status actions (including power-off or deletion) based on retention policy. Current retention window: 7-day grace period plus 14-day suspended retention (21 days total).

11. Liability and Warranty Disclaimer

To the maximum extent permitted by law, ActivateClaw disclaims warranties of uninterrupted availability, fitness for a particular purpose, and non-infringement. You are responsible for your usage, your data, and outputs produced by your configured AI systems.

Our total liability for any claim arising from or related to the service is limited to the amount you paid for the service in the 3 months preceding the claim.

12. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via email to your registered address. The "Last updated" date at the top reflects the most recent revision. Continued use of the service after changes constitutes acceptance.

13. Governing Law

These terms are governed by the laws of India. Any disputes will be resolved in the courts of Bangalore, India.

14. Software Version and Updates

Each server is deployed with a specific tested version of OpenClaw. The version deployed at the time of provisioning is shown in your dashboard. While OpenClaw may offer in-app updates, applying those updates is entirely at your discretion and risk.

ActivateClaw does not guarantee compatibility, stability, or functionality after user-initiated software updates. If an update introduces issues, resolution is your responsibility. We recommend staying on the deployed version unless you have a specific reason to update.

Additionally, some pre-installed skills may require one-time configuration via the server terminal (accessible through Developer SSH Access). This may include authenticating with third-party services, setting API keys, or completing provider-specific setup steps.
